And the answer is the following: There are three topics to discuss, planting, possession and transportation. It is about these that consumers must process a permit before the Federal Commission for the Protection against Sanitary Risks (Cofepris) of the Ministry of Health where it will strictly say that it is for personal use.
This requirement, in fact, already exists today. According to México Unidos Contra la Delincuencia (MUCD), an organization that has actively promoted the regularization of personal cannabis use, some 2,500 people have requested this permit since 2018.
The response they received was always negative due to the prohibitions provided until now in the law.
This forced consumers to resort to an amparo trial in which the magistrates agreed to grant them permission based on the already existing jurisprudence on the unconstitutionality of the regulations.
But now that the Supreme Court eliminated these articles from the General Health Law, the health authorities must issue these permits.
In practice, therefore, the main change is that interested parties will no longer have to resort to the courts to authorize their personal consumption and this is a great advance. Those of us who have been seeking our permission for years and have had to protect ourselves, know this very very well. Thanks to all those who have never given up so that consumption is free.
